Terms and Conditions of Rental
Please read the terms and conditions of the Rental Agreement (“Terms and Conditions”) before You sign the Cars for Rent Pty Ltd rental Agreement form (Part A). You can also access this document online at our Website on www.cars4rent.au
The following pages contain important information that You and any other Authorised Drivers need to know. This includes your responsibilities to Cars for Rent Pty Ltd and Cars for Rent Pty Ltd responsibilities to You. This Agreement is in addition to your rights under Australian Consumer Law, Fair Trading NSW and other applicable legislation that apply in the state of your rental Agreement. Your consumer rights are not excluded, modified, or restricted by this Rental Agreement.
By signing the rental Agreement , You and Your Authorised Drivers acknowledge that You and Your Authorised Drivers have read and understood all of the Rental Agreement including these Terms and Conditions and that You and Your Authorised Drivers are legally bound to it. You also expressly agree that Cars for Rent Pty Ltd can recover any additional charges outlined in the Rental Agreement from You.
This includes all relevant administration charges, fees, theft, loss and damage costs (subject to any relevant excesses applying), toll charges, parking, traffic or other fines or charges, court costs and/or any other charges.
If You or Your Authorised Drivers require further information or clarification about this Rental Agreement please ask a member from our team.
Definitions
These definitions apply unless the context requires a different interpretation:
The Company
means Cars For Rent Pty Ltd ABN 96 929 523 414 ATF The Cars for Rent Unit Trust , also referred to as “We”, “Us” or “Our”
Rental Agreement
The Rental Agreement is a legally binding contract between the hirer (You) and any Authorised drivers and the Company identified on page 1 of the rental document where You agree to rent the Vehicle described in schedule one including all the accessories, tools, equipment, and tyres of the Vehicle.
Rental Start Date
means the date the Agreement commences and includes the time You pick up the Vehicle.
Rental Amount
Means all the fees and amounts referred to in the rental document or payable under this Agreement.
Rental Location
The pick up location of your rental Vehicle.
Authorised Drivers
means drivers who have been authorised to drive the Vehicle by Cars for Rent Pty Ltd and are noted as Authorised Drivers on the Rental Agreement.
You/Your
The person who signed the Rental Agreement.
Vehicle
Means the Vehicle You have rented and is described in the rental form and includes all the parts and components, keys, tags and accessories.
Accessory
Equipment provided by us that is additional to the Vehicle and VMS and GPS.
Material Breach of the Rental Agreement
A material breach occurs if the Vehicle is used for Prohibited Use or the driver has provided false or misleading information or becomes unlicensed during rental period or You fail to pay the rental amount within the rental period.

Applicable Consumer Protection Law
Means the Australian Consumer law or any law applicable.
Vehicle Monitoring System “VMS”
Our Vehicles are fitted with this electronic tracking device to track the Vehicles location, distance and speed of Vehicle and to immobilise the Vehicle if required during the rental period.
Designated return time
means the date and time identified in your Rental Agreement for return of the Vehicle.
Designated return location
means the location identified in your Rental Agreement for return of the Vehicle. If no return location is specified, the Designated Return Location is the same location where your rental commences.
Damage to Vehicle
Damage to Vehicle include scratches to bodywork, Damage to mirrors, Damage to lights including: chips, holes, scratches and cracks., Wheel trims cracked, broken, missing, mismatched or not original., Damage to alloy wheels, Any missing original equipment as noted, Trim damage or missing parts of the interior trim, Upholstery burns, cuts, stains or tears to the seats, carpets, roof lining and material in the glove box/boot, Excessively dirty or smelly Vehicle., and damage to glass.
Security Deposit
means the sum paid by You to the Company as a deposit against any breach by the You or any Authorised Drivers of any provision of this Agreement.
Total Loss
means total destruction or permanent damage to the Vehicle which renders it totally unusable and such that the cost of repair is not less than 85 % of the cost of new Vehicle of a similar type.
Collection Costs
means The Company reasonable costs of collecting unpaid rental charges from You (including The Company legal costs) and the Company administration fee of $132.00 (incl GST) and its debt collection agents fee equal to 12% of the unpaid Rental Charges;
Excess Amount
means the amount shown as Excess Amount on the Rental Agreement.
Loss Damage Waiver
means the loss damage waiver described on the Rental Agreement as LDW which reduces your financial responsibility for loss damage to the Vehicle to the Excess Amount;
Overhead Damage
means damage (excluding hail damage) to the Vehicle above the top of the door seal or the top of the front and back windscreens, or damage to the third party property, caused by the Vehicle coming into contact with anything overhanging or obstructing its path, objects being placed on the roof of the Vehicle, or You or any person standing or sitting on the roof of the Vehicle.
